Issues in Supply Chain Logistics Outline PURCHASING CASE STUDY 1 Communication forms the most important part as far the supply chain is concerned. It is through well enhanced communication that buyers and sellers can interact well and their separate needs. The most important lesson I derived from the case study is the importance of harmonizing ideas among the working groups. If the flow of ideas between the concerned parties is not proper, it may lead to total failure. In order for the working procedure to be functional, a supply chain is composed of different elements which are reliant on each other. Each of these parameters needs to be reviewed. The customer initiates the supply chain by making the required order. This is then processed by the supplier and finally the consumer receives the package. Hence, there are several elements entailed in such a transaction. To begin with, inbound logistics is crucial during the supply chain. This is closely followed by the outbound logistics in addition to customer care and operations division. None of these processes can be ignored if the supply chain is to succeed. There were some missing links as can be noted form the case study. For instance, the quantities of goods shipped were much more than the actual level agreed upon. This affected the inbound logistics. As a result, there was a lot of mess especially when these goods were to go through the outbound logistics. The operations department suffered a lot. Besides, customers who could not get their packages delivered on time got angry hence unsatisfied. It is imperative to consider the available time against the volume of goods to be handled if supply chain is to record any success. 2) Delayed shipment is one of the main problem which led to the entire mess of the supply chain logistics. Therefore, the supplier carried the blame having agreed so. Besides, the very supplier did not issue the accurate information detailing the quantity of goods to be supplied. Although this appeared to be the key issue at hand, later deliberations revealed that the actual problem was lack of understanding between the supplier and the customer when the initial quotation was being made. These factors hampered the operations in the shipment and delivery of the goods. Although the supplier attempted to communicate with the customer care department regarding challenges in production, no positive feedback was received thereby complicating the entire process. 3) Opting for a different supplier would be a better alternative for Avion, Inc. However, there were several pending deals with the initial supplier. Such an action would just aggravate the situation. Hence, it would only be necessary to clear the current backlog of supplies before delegating the work to a different supplier. This will also assist in restoring customer confidence. In fact, the process of selecting another supplier would require more than just enough time and it would be better off if Avion, Inc. clear all the current deals first. 4) The best way to resolve the issue is by getting to the bottom of the problem. It is important for the company to seek the root cause of the problem, who was actually responsible or failed to do their part and the reason why that happen. In fact, blame game cannot help much at this point. Every detail should be keenly filtered in a bid to establish the truth and possible solutions for the same. The reverse method can achieve much in the process of resolving this problem. Although the magnitude of the problem might appear to be small, no single element can be ignored because it may as well as graduate to level difficult to handle. 5) As a customer, it is imperative to play our parts well and in a manner that will not jeopardize the relationship with the supplier or producer. The bargain end with the supplier should be clear to avoid any possible misunderstanding which may arise due to late deliveries or wrong quantities of deliveries. Additionally, good customer will equally seek an understanding with the supplier whenever some eventualities occur. For instance, delays which may result from transport logistics should not cause a breaking point in the relationship between the supplier and customer. Therefore, it is possible to maintain a cordial relationship between the customer and supplier if the former can resort to understanding of the situation at hand. 6) When the supply chain is keenly monitored or scrutinized at every important point, it will account to what is referred to as performance measurement. This does not only assist in assessing the progress of the chain but also giving a thorough evaluation of how efficient the process is running. Information obtained from performance can be used to make necessary adjustments whenever weaknesses are noted. Performance measurement will also ensure that extremely weak points within the supply chain are overhauled or completely modifies. Hence, it is a very important form of monitoring and evaluation which will always ensure sustained growth in a company. 7) The supply chain logistics will definitely experience change from time to time bearing in mind that the market if often very dynamic and which will quite regularly call for changes. Nevertheless, any change effected will depend on a wide array of factors which must also be put into consideration. Every individual change needs to undergo some form of evaluation to see into it that it will not cause any constraint but rather will enhance the supply process. Consequently, Avion will be in a position o make more profit. 9) It is necessary to consider both the single source contract and the multiple source contracts. In the first case, goods are obtained from one supplier regardless of the circumstances at hand. On the other hand, multiple source contract permits the customer to obtain goods from a variety of suppliers. The main advantage of the multiple source contracts is that it is always possible to make adjustments in the supply needs depending on the market forces such as demand. However, if the single source contract is adopted, it will be imperative for both the customer and the supplier to create some working goal to be adhered to just in case the two parties break from the norm. in order to improve the relationship between the supplier and the customer, it is upon the customer to set some specific targets which will also match the ability and capacity of the supplier so that minimal hitch is encountered in course of the two carrying out transactions. The guidelines to be followed by the suppli er and the customer should be clearly understood by the two and by so doing; the supply chain will experience positive growth. 10) This case has presented a myriad of issues which definitely require to be addressed expeditiously in order to avoid similar challenges arising in future. The supply chain process can be made better if the following proposals are put into action. Avion should seek to avoid extremely large quantities as far as deliveries are concerned. In addition, they should stick to their time and program of deliveries as agreed upon by Foster technologies. Moreover, the lead time should be borne in mind by Avion so that prompt deliveries are put in place. The challenges portrayed in this case study are sometimes inevitable and can best be resolved if the root causes are established right from the start. PURCHASING CASE STUDY 2 What do you do in the first 60 days? I will begin by restructuring all the departments in each of the plants after a careful evaluation of the current state. To be able to achieve this, meetings will be necessary. All the departmental representatives will have to attend regular meetings to report on the pertinent information regarding operations within their areas of concern. Besides, each of the individual plants should have the willingness to experience change. For instance, there would be no need for plant managers to be directly responsible vice president of operations. Hence, shifts for the workers should be well planned to take care of eventualities like accidents at work place. Financial availability of the project should be analyzed by an efficient project manager who should give the right feedback. The manager can either be outsourced or in-sourced. Workers who are outsourced should be well oriented or perhaps the company should have the understanding of the workers located in different parts and plan for their working requirements in the most satisfying manner. On the other hand, a business contract which has been facilitated by two or more businesses as a result of seeking ways of improving performance is referred to as an alliance. Some of the reasons why businesses can resort to alliance system are to reduce production costs and also improve customer experience of the goods and services being offered. Risks and opportunities are taken care of by all the members in the alliance. I strongly believe that partnerships can work well in situa tions where both businesses have a comparative operating capacity in the market and that none of the partners has an advantage position than the other. An alliance is best applied when there is need to outsource products from another company due to cost advantage among other reasons. Each of the organization in the alliance is independent to run its affairs and none can stamp an authority over the other. Develop a process that firms can use when identifying and developing supply chain alliances Firstly, planning forms the fundamental starting point when developing the supply chain alliances. It begins by choosing an organisation which has the capacity to form the best alliance. In addition, the goals and objectives need to be clearly crafted out including the requirements of which services to be offered. The evaluation process should also be established to ensure that performance timelines and deadlines are met. Agreements which are mutually beneficial should be anchored so that no alliance member gets a feeling of unfair deal. This will also usher in the need to harness a good working relationship among the alliance members who are supposed to share any pertinent information regarding the agreement. Furthermore, matters regarding tradeoffs should be discussed in details to allow a profitable venture experience between or among the alliance members. Finally, training should be organized to cater for the capacity building and professionalism of the staff across the organizat ions. This will definitely improve the standard of the employees and commodities and services being delivered.

It was like I could see his shifting tactics written on his features. His eyes widened, suddenly anxious. ââ¬Å"I'm worried, Bree. I told you that she was going to meet us, to help us, but I haven't crossed her trail. Something's wrong. I need to find her.â⬠ââ¬Å"But there's no way you can find her before Raoul gets to the yel ow-eyes,â⬠I pointed out. ââ¬Å"I have to find out what's going on.â⬠He sounded genuinely desperate. ââ¬Å"I need her. I wasn't supposed to do this alone!â⬠ââ¬Å"But the othersâ⬠¦Ã¢â¬ ââ¬Å"Bree, I have to go find her! Now! There are enough of you to overwhelm the yel ow-eyes. I'l get back to you as soon as I can.â⬠He sounded so sincere. I hesitated, glancing back the way we had come. Fred would be halfway to Vancouver by now. Riley hadn't even asked about him. Maybe Fred's talent was stil in effect. ââ¬Å"Diego's down there, Bree,â⬠Riley said urgently. ââ¬Å"He'l be part of the first attack. Didn't you catch his scent back there? Did you not get close enough?â⬠I shook my head, total y confused. ââ¬Å"Diego was there?â⬠ââ¬Å"He's with Raoul by now. If you hurry, you can help him get out alive.â⬠We stared at each other for a long second, and then I looked south after Raoul's path. ââ¬Å"Good girl,â⬠Riley said. ââ¬Å"I'l go find her and we'l be back to help clean up. You guys have got this! It might be over by the time you get there!â⬠He took off in a direction perpendicular to our original path. I clenched my teeth at how sure he seemed of his way. Lying to the end. But it didn't feel like I had a choice. I headed south in a flatout sprint again. I had to go get Diego. Drag him away if it came to that. We could catch up with Fred. Or take off on our own. We needed to run. I would tel Diego how Riley had lied. He would see that Riley had no intention of helping us fight the battle he'd set up. There was no reason to help him anymore. I found the human's scent and then Raoul's. I didn't catch Diego's. Was I going too fast? Or was the human's scent just overpowering me? Half my head was absorbed in this strangely counterproductive hunt ââ¬â sure, we would find the girl, but would we be ready to fight together when we did? No, we'd be clawing each other apart to get to her. And then I heard the snarling and screaming and screeching explode from ahead and I knew the fight was happening and I was too late to beat Diego there. I only ran faster. Maybe I could stil save him. I smel ed the smoke ââ¬â the sweet, thick scent of vampires burning ââ¬â carried back to me on the wind. The sound of mayhem was louder. Maybe it was almost done. Would I find our coven victorious and Diego waiting? I dashed through a heavy fringe of smoke and found myself out of the forest in a huge grassy field. I leaped over a rock, only to realize in the instant I flew past it that it was a headless torso. My eyes raked the field. There were pieces of vampires everywhere, and a huge bonfire smoking purple into the sunny sky. Out from under the bil owing haze, I could see dazzling, glittering bodies darting and grappling as the sounds of vampires being torn apart went on and on. I looked for one thing: Diego's curly black hair. No one I could see had hair so dark. There was one huge vampire with brown hair that was almost black, but he was too big, and as I focused I watched him tear Kevin's head off and pitch it into the fire before leaping on someone else's back. Was that Jen? There was another with straight black hair that was too smal to be Diego. That one was moving so fast I couldn't tel if it was a boy or a girl. I scanned quickly again, feeling horribly exposed. I took in the faces. There weren't nearly enough vampires here, even counting those that were down. I didn't see any of Kristie's group. There must have been a lot of vampires burned already. Most of the vampires stil standing were strangers. A blond vampire glanced at me, meeting my gaze, and his eyes flashed gold in the sunlight. We were losing. Bad. I started backing toward the trees, not moving fast enough because I was stil looking for Diego. He wasn't here. There was no sign he had ever been here. No trace of his scent, though I could distinguish the smel s of most of Raoul's team and many strangers. I had made myself look at the pieces, too. None of them belonged to Diego. I would have recognized even a finger. I turned and real y ran for the trees, suddenly positive that Diego's presence here was just another of Riley's lies. And if Diego wasn't here, then he was already dead. This fel into place for me so easily that I thought I must have known the truth for a while. Since the moment that Diego had not fol owed Riley through the basement door. He'd already been gone. I was a few feet into the trees when a force like a wrecking bal hit me from behind and threw me to the ground. An arm slipped under my chin. ââ¬Å"Please!â⬠I sobbed. And I meant please kill me fast. The arm hesitated. I didn't fight back, though my instincts were urging me to bite and claw and rip the enemy apart. The saner part of me knew that wasn't going to work. Riley had lied about these weak, older vampires, too, and we'd never had a chance. But even if I'd had a way to beat this one, I wouldn't have been able to move. Diego was gone, and that glaring fact kil ed the fight in me. Suddenly I was airborne. I crashed into a tree and crumpled to the ground. I should have tried to run, but Diego was dead. I couldn't get around that. The blond vampire from the clearing was staring intently at me, his body ready to spring. He looked very capable, much more experienced than Riley. But he wasn't lunging at me. He wasn't crazed like Raoul or Kristie. He was total y in control. ââ¬Å"Please,â⬠I said again, wanting him to get this over with. ââ¬Å"I don't want to fight.â⬠Though he stil held himself ready, his face changed. He looked at me in a way I didn't total y get. There was a lot of knowledge in that face, and something else. Empathy? Pity, at least. ââ¬Å"Neither do I, child,â⬠he said in a calm, kind voice. ââ¬Å"We are only defending ourselves.â⬠There was such honesty in his odd yel ow eyes that it made me wonder how I had ever believed any of Riley's stories. I feltâ⬠¦ guilty. Maybe this coven had never planned to attack us in Seattle. How could I trust any part of what I'd been told? ââ¬Å"We didn't know,â⬠I explained, somehow ashamed. ââ¬Å"Riley lied. I'm sorry.â⬠He listened for a moment, and I realized that the battlefield was quiet. It was over. If I'd been in any doubt over who the winner was, that doubt was gone when, a second later, a female vampire with wavy brown hair and yel ow eyes hurried to his side. ââ¬Å"Carlisle?â⬠she asked in a confused voice, staring at me. ââ¬Å"She doesn't want to fight,â⬠he told her. The woman touched his arm. He was stil tensed to spring. ââ¬Å"She's so frightened, Carlisle. Couldn't weâ⬠¦Ã¢â¬ The blond, Carlisle, glanced back at her, and then he straightened up a little, though I could see he was stil wary. ââ¬Å"We have no wish to harm you,â⬠the woman said to me. She had a soft, soothing voice. ââ¬Å"We didn't want to fight any of you.â⬠ââ¬Å"I'm sorry,â⬠I whispered again. I couldn't make sense of the mess in my head. Diego was dead, and that was the main thing, the devastating thing. Other than that, the fight was over, my coven had lost and my enemies had won. But my dead coven was ful of people who would have loved to watch me burn, and my enemies were speaking to me kindly when they had no reason to. Moreover, I felt safer with these two strangers than I'd ever felt with Raoul and Kristie. I was relieved that Raoul and Kristie were dead. It was so confusing. ââ¬Å"Child,â⬠Carlisle said, ââ¬Å"wil you surrender to us? If you do not try to harm us, we promise we wil not harm you.â⬠And I believed him. ââ¬Å"Yes,â⬠I whispered. ââ¬Å"Yes, I surrender. I don't want to hurt anybody.â⬠He held out his hand encouragingly. ââ¬Å"Come, child. Let our family regroup for a moment, then we'l have some questions for you. If you answer honestly, you have nothing to fear.â⬠I got up slowly, making no movements that could be considered threatening. ââ¬Å"Carlisle?â⬠a male voice cal ed. And then another yel ow-eyed vampire joined us. Any sort of safety I'd felt with these strangers vanished as soon as I saw him. He was blond, like the first, but tal er and leaner. His skin was absolutely covered in scars, spaced most thickly together on his neck and jaw. A few smal marks on his arm were fresh, but the rest were not from the brawl today. He had been in more fights than I could have imagined, and he'd never lost. His tawny eyes blazed and his stance exuded the barely contained violence of an angry lion. As soon as he saw me he coiled to spring. ââ¬Å"Jasper!â⬠Carlisle warned. Jasper pul ed up short and stared at Carlisle with wide eyes. ââ¬Å"What's going on?â⬠ââ¬Å"She doesn't want to fight. She's surrendered.â⬠The scarred vampire's brow clouded, and suddenly I felt an unexpected surge of frustration, though I had no idea what I was frustrated with. ââ¬Å"Carlisle, Iâ⬠¦Ã¢â¬ He hesitated, then continued, ââ¬Å"I'm sorry, but that's not possible. We can't have any of these newborns associated with us when the Volturi come. Do you realize the danger that would put us in?â⬠I didn't understand exactly what he was saying, but I got enough. He wanted to kil me. ââ¬Å"Jasper, she's only a child,â⬠the woman protested. ââ¬Å"We can't just murder her in cold blood!â⬠It was strange to hear her speak like we both were people, like murder was a bad thing. An avoidable thing. ââ¬Å"It's our family on the line here, Esme. We can't afford to have them think we broke this rule.â⬠The woman, Esme, walked between me and the one who wanted to kil me. Incomprehensibly, she turned her back to me. ââ¬Å"No. I won't stand for it.â⬠Carlisle shot me an anxious glance. I could see that he cared a lot for this woman. I would have looked the same way at anyone behind Diego's back. I tried to appear as docile as I felt. ââ¬Å"Jasper, I think we have to take the chance,â⬠he said slowly. ââ¬Å"We are not the Volturi. We fol ow their rules, but we do not take lives lightly. We wil explain.â⬠ââ¬Å"They might think we created our own newborns in defense.â⬠ââ¬Å"But we didn't. And even had we, there was no indiscretion here, only in Seattle. There is no law against creating vampires if you control them.â⬠ââ¬Å"This is too dangerous.â⬠Carlisle touched Jasper's shoulder tentatively. ââ¬Å"Jasper. We cannot kil this child.â⬠Jasper glowered at the man with the kind eyes, and I was suddenly angry. Surely he wouldn't hurt this gentle vampire or the woman he loved. Then Jasper sighed, and I knew it was okay. My anger evaporated. ââ¬Å"I don't like this,â⬠he said, but he was calmer. ââ¬Å"At least let me take charge of her. You two don't know how to deal with someone who's been running wild so long.â⬠ââ¬Å"Of course, Jasper,â⬠the woman said. ââ¬Å"But be kind.â⬠Jasper rol ed his eyes. ââ¬Å"We need to be with the others. Alice said we don't have long.â⬠Carlisle nodded. He held his hand out to Esme, and they headed past Jasper back toward the open field. ââ¬Å"You there,â⬠Jasper said to me, his face a glower again.

What makes a photographer influential? Photographers capture emotion, represent stories, and convey history. If you look at portraits of modern celebrities, you are likely to come across the name Annie Leibniz. She has taken portraits of everyone from John Lennox and Queen Elizabeth II to Michael Jackson and Bill Gates. Her photographs have appeared in a number of different fashion and music magazines over the course of her career. Leibniz was born in Waterbury, Connecticut in 1949. Her father was a member of the UnitedStates Air Force, and the family moved frequently around the world. It was in the Philippines that Leibniz took some of her first photographs, and her interest in art and music flourished in high school. Returning to the United States after living in Israel, Leibniz took a Job with Rolling Stone magazine. Her first cover image appeared on January 12, 1971, and she became the chief photographer for the magazine in 1973. For the next ten years, her style of photographing celebrities helped to define not only the magazine that she worked for, but also the style of portraits that appeared in other magazines and mediums.In the sass, Leibniz left Rolling Stone and went to work for Vanity Fair, continuing to photograph celebrities for the magazine. Known for his black and white photographs of the western United States, Adams took landscape photographs that brought remote places to people long before travel was possible and highlighted environmental concerns. Ansell Adams, born in February 1902 in San Francisco, California, was an only child.Drawn to nature at an early age, e explored the sea coast and collected insects. He was also trained as a concert pianist. During a family trip to Yosemite National Park, Adams' father gave him a Kodak Brownie camera, beginning his love for photography. Adams returned to the park the following year to do more photography. He learned darkroom techniques by working part time for a photo finisher. At seventeen, Adams Joined the Sierra Club, a group dedicated to preserving natural spaces, and spent several summers as the caretaker for its lodge in the Yosemite Valley.In 1921, Adams sold his first photographs. Despite experimenting with different photograph techniques, Adams referred realism. In 1927, he completed his first portfolio and earned about $3,900, which led to commercial assignments for portraits. By 1931, Adams had his first solo museum exhibition at the Smithsonian Institution that featured sixty photographs he had taken of the Sierra Mountains. With Edward Weston, M. H. De Young Museum, and Imagine Cunningham, Adams formed Group f/64, with a commitment to ââ¬Å"straightâ⬠photography instead of artistic interpretation.The name came from the small aperture setting (f/64) which gave the greatest depth of field for a photograph. Adams also opened his own photography gallery in San Francisco. One of Adams' contributions to photography was the development of his Zone System. The Zone System was a way of adjusting the exposure in a photograph to maximize shadows and highlights. It separated the tones between white and black into eleven different zones that corresponded to an f/stop, with middle gray at the center. The system helped to correctly expose a photograph to avoid being under- or overexposed.A photographer would choose an area of the photograph, meter the area, and then adjust the exposure using the system to put the area of the photograph into the exposure that best measures the area. For example, if you are photographing a mountain scene, bright snow might be metered at a zone V (5), but you want it at a zone IX (9). Using the system, you would know to increase the f/stop by four f/stops to get the exposure that you want for the photograph. The Zone System was later applie d to color film and with digital images. 1 1. Edward Weston Edward Weston emphasized the beauty of natural form. His photographs reveal and focus on the natural form of a single item, taken in sharp detail. His photographs are among the most expensive ever sold. Edward Weston was born in Highland Park, Illinois in 1886. He received his first camera, a Kodak Bulls-Eye No. 2, as a present for his sixteenth birthday. He took the camera on a family vacation in the Midwest before buying a 5 x 7 camera and beginning to learn darkroom techniques. Soon, he was photographing Chicago parks and the areas around his aunt's farm.In 1906, he submitted a photograph to Camera and Darkroom, which published the photograph in a full-page reproduction. In 1906, Weston moved to California, but moved back to Illinois a year later to attend the Illinois School of Photography. After finishing the coursework, Weston again moved to California and began work in several hoteliers' studios, learning the busines s. In 1911, he opened ââ¬Å"The Little Studioâ⬠and took photographs of children and friends, gaining recognition for his work. The following year, he received another grant and published Seeing California with Edward Weston, another publication of his travels, in 1939. The following year, California and the West was published.In 1945, Weston began to exhibit signs of Parkinson disease. By 1948, he was no longer physically able to use a camera but continued to exhibit his work and publish some of the photogr aphs that he had taken earlier in his life. He died in 1958. One of his favorite beaches, and the subject of many photographs in Point Lobos, California, was later renamed Weston Beach in his honor. 1 1. 4 Throated Lange Best remembered for her images of the Southern poor and those starting over in the West, Throated Lange documented the hard times of the Depression era and revealed social difficulties.Her iconic images have come to be the face of the Depression. Lange was born in 1895 in Hoboken, New Jersey. After a childhood marked by polio, Lange became an informal apprentice in several New York photography studios. She moved to San Francisco in 1918 and opened her own studio. When the Great Depression hit the United States in the late sass, Lange was moved to document the people hardest hit by the financial crisis. She was hired by the Resettlement Administration, later renamed the Farm Security Administration. Lane's photographic focus was the unemployed and homeless.In 1941, L ange worked for the War Relocation Authority to document the forced evacuation of Japanese Americans on the West Coast to relocation camps. She photographed the relocation process and the lives of the Japanese Americans in the camps, focusing most of her attention on Manager, one of the first permanent relocation camps in California. The government considered the photographs too critical of the relocation and impounded them; they are now available for viewing through the National Archives. After WI, Lange continued her work in photography with a slightly different position than her earlier social commentary work.Ansell Adams offered Lange a faculty position at the California School of Fine Arts, which had the first fine arts photography department. Lange also helped to co-found the photography magazine Aperture. In 1965, at the age of 70, Throated Lange died of esophageal cancer. The right to seek transfer of the perpetrator or their own transfer should be given to the victims of sexual harassment. Therefore, an appropriate complaint mechanism should be created in the employerà ¢Ã¢â ¬Ã¢â ¢s organization in order to put right on the complaint made by the victim. Such complaint mechanism should ensure time bound treatment of complaints. First, section 294 provides that if whoever does any obscene act in any public place, whether sings, recites or utters any obscene songs ballads or words, in or near any public place, can be punished with imprisonment for a term which may extend to three months, or with fine or both. Second, section 354 provides if whoever assaults or uses criminal force on any woman, intending to outrage her modesty or knowing it li kely that he will thereby outrage her modesty, can be punished with imprisonment for a term which may extend to two years, or with fine or both. Also in the Indian Penal Code, section 509 provides that, whoever intending to insult the modesty of a woman, utters any words, makes any sound or gesture, or exhibits any object, intending that such word or sound shall be heard, or that such gesture is seen by such woman, or intrudes upon the primary of such woman, shall be punished with simple imprisonment for a term which may extend to one year, or with fine or both. In addition, Indecent Representation of Women (Prohibition) Act 1987 provides that, if anyone harasses another person with books, photographs, paintings, films, pamphlets, packages, etc. which containing the à ¢Ã¢â ¬Ã

âThe Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013 had finally brought into force which dealing with the protection of women against sexual harassment at workplaces. This Act has in fact followed the decision in the Vishakaà ¢Ã¢â ¬Ã¢â ¢s case. In adopting the statement in the Vishakaà ¢Ã¢â ¬Ã¢â ¢s case by the Supreme Court, Section 2n of this Act has defined sexual harassment to include any one or more of the following unwelcome acts or behavior (whether directly or by implication) namely: (i) a demand or request for sexual favors; (ii) physical contact and advances; (iii) showing pornography; (iv) any other unwelcome physical, verbal or non-verbal conduc t of sexual nature; or (v) making sexually colored remarks. Further, the Act also add in the following which may also amount to sexual harassment: (i) implied or explicit threat about present or future employment status; (ii) implied or explicit threat of detrimental treatment; (iii) implied or explicit promise of preferential treatment; (iv) interference with work or creating an intimidating or offensive or hostile work environment; or (v) humiliating treatment likely to affect health or safety. At district and block levels, the Act contemplates the constitution of Internal Complaints Committee at the work place and Local Complaints Committee. A District Officer shall be responsible for facilitating and monitoring the activities under the Act. Every workplace employing ten or more than ten employees is required to constitute an Internal Complaints Committee. The Internal Complaints Committee is required to consist of at least four members, and its presiding officer is requ ired to be a woman who at a senior level. In case if no senior woman employee is available, may nominate a woman presiding officer from another office, administrative unit, workplace, or organization. Further, one half of the members must be women. Local Complaints Committees are to be set up by the government which shall receive complaints in respect of establishments that do not have Internal Complaints Committees on account of having less than ten employees and to receive complaints from domestic workers. Based on this Act, it also provides five steps of complaint process. First, a complaint needs to be made in writing by an aggrieved woman within three months of the date of the incident. The time limit may be extended for another three months if, in where the situation, the woman was unable to file the complaint. If the aggrieved woman is unable to make a complaint because of her physical or mental incapacity or death, then her legal heirs may make the complaint on behalf of the victims. Second, upon receipt of the complaint, the Internal Complaints Committee or Local Complaints Committee must proceed to make an inquiry in accordance with the service rules applicable to the respondent or in their absence, in accordance with rules framed under the Act. Third, the inquiry must be completed within a period of 90 days. In case of a complaint by a domestic worker, if in the opinion of the Local Complaints Committee a prima facie case exists, the Local Complaints Committee is required to forward the complaint to the police to register a case under the relevant provisions of the Indian Penal Code. Forth, where the Internal Complaints Committee finds that the allegations against the respondent are proven, Internal Complaints Committee must submit a report to the employer to take action against the offender follow the rules provided under the Act and deduct his wages or salary and such deduction shall be given to the victims as compensation. Lastly, the employer must act on these recommendations given by the Internal Complaints Committee within 60 days. On the part of the duties of the employer, the case law stated earlier has been used where been put into the Act and makes it the duty for every employers to: a) provide a safe working environment at the workplace which shall include safety from all the persons with whom a woman comes into contact at the workplace; b) display at any conspicuous place in the workplace, the penal consequences of sexual harassment and the order constituting the Internal Complaints Committee; c) organize workshops and awareness programs; d) provide necessary facilities to the Internal Complaints Committee for dealing with complaints and conducting inquiries; e) assist in securing the attendance of the respondent and witnesses before the Internal Complaints Committee; f) make available such information to the Internal Complaints Committee or Local Complaints Committee, as it may require; g) provide a ssistance to the woman if she so chooses to file a criminal complaint; h) initiate criminal action against the perpetrator; i) treat sexual harassment as a misconduct under the service rules and initiate action for such misconduct; and j) monitor the timely submission of reports by the Internal Complaints Committee. If the employer fails to obey with the provisions of the Act, he or she shall be liable to be punished with a fine Rs. 50,000(RM2,675++).
